Post-Accident Drug Test
If a client/employer/employee/manager calls to report an accident, please ask the following questions.
Questions
- Is the driver a CDL/Non-CDL?
- What vehicle was he driving? - (We need to know if a CDL is required to operate the vehicle (16 or more passengers in all states except California and New Jersey.))
- Was the driver ticketed?
- Was anyone injured?
- Were there any fatalities (deaths)?
- Was any vehicle towed?
- What is the manager's name of the driver?
Types of drug tests we have to schedule:
CDL drivers, IF driving a CDL vehicle:
- If someone died in the accident, A DOT drug AND DOT BAT (always FMCSA unless the driver is from RMA driving in Baltimore, then it is FTA)
- If the driver did NOT receive a ticket, then NO test is required by law. (The company may choose to do a non-DOT drug test.)
The two combination rule when driving a CMV : - Ticket+ towed= DOT drug and BAT test
- Ticket+ injury= DOT drug and BAT test
- HOWEVER
Injury +towed with no ticket means no DOT test (the company may choose to do a non-DOT drug test.)
CDL drivers, IF NOT driving a CDL vehicle:
- The company may choose to do a non-DOT drug test & optional BAT.
-Non-CDL drivers
- The company may choose to do a non-DOT drug test & optional BAT.
Notes
- Post Accident tests will always have to be drug and alcohol.
- The drug test can be taken within 24 hours.
- Alcohol test (BAT) has to be taken within 2 hours ( can be completed within 8 hours, but if it's more than 2 hours, they will have to give us a reason why)
